General
1. E-Tours Ltd. (hereinafter "E-Tours") is a 100% New Zealand-owned and operated inbound educational tourism provider with its registered office in Raglan. Its trading activities are related to tourism services in New Zealand and, in particular, the provision of educational and special interest tours and recreational English language courses, E-Tours has been granted official exemption by the New Zealand Qualifications Authority from the requirement to be accredited in accordance with Section 232 1 (b) of the New Zealand Education Act 1989 (due to offering courses of less than 3 months duration).
Intellectual Property:
2. Copyright, trademark, patent, and/or other intellectual property laws protect the materials in this web, as well as their selection and arrangement. Any unauthorized use of the materials may violate such laws and the Terms of Use. Except as expressly provided herein, E-Tours and its suppliers do not grant any express or implied rights to use the materials. You agree not to copy, republish, frame, transmit, modify, rent, lease, loan, sell, assign, distribute, license, sublicense, reverse engineer, or create derivative works based on this web, its materials, or its selection and arrangement, except as expressly authorized herein.
3. This website may not be modified or altered in any way nor may it be distributed or sold, rented, leased, or licensed to others.
4. E-Tours does not warrant or make any representations regarding the correctness, accuracy, reliability, or otherwise of the materials in this site or the results of their use.
5. All disputes arising out of these terms and conditions will be governed by the law of New Zealand.
Tours
6. E-Tours reserves the right to refuse to accept any participant on board a tour at its sole discretion. This right will be used in circumstances, including but not limited to where a passenger is not, in E-Tours judgement, physically or psychologically fit to travel or where the passenger's behaviour is deemed to place the rest of the group and/or the reputation of E-Tours in jeopardy. Normal refund policy will apply in such circumstances. In the event that a participant is requested to leave a tour mid-course, the participant is solely responsible for his or her onward travel and any other expenses incurred.
7. E-Tours reserves the right to alter the accommodation, carriers or modes of transport at any time for any reason. E-Tours also reserves the right to cancel or alter the itinerary and/or tour without notice as may be necessary for any reason whatsoever, including but not limited to road, weather or traffic conditions, non-performance of suppliers, industrial action, terrorism, acts or warning of government, operational conditions and requirements and serious illness. All additional expenses incurred as a result of any delays, cancellations or alterations will be the sole responsibility of the passenger.
8. E-Tours is not liable for and does not accept responsibility for personal injury or property damage or loss arising out of its activities. E-Tours is not responsible and disclaims liability for any injury, damage, loss, delay or change in itinerary of schedules, additional expenses, inconvenience or irregularity incurred during the tour relating to supply or omission of transportation, accommodation, facilities, meals or other services, or illness of participants.
9. E-Tours is not responsible for mechanical breakdowns, government actions, weather, acts of God, strikes, force majeure or other circumstances beyond its control., including but not limited to failure by a passenger to follow instructions.
10. All fees are quoted in New Zealand dollars and include 12.5% Government Services Tax ("GST").
11. E-Tours is not responsible for any fluctuations in currency exchange rates which may result in a passenger being charged more than the published or quoted price, nor is it responsible for any bank or other third party charges made in relation to foreign currency transactions.
12. All fees include the following services:
- Services of a professional, appropriately licenced driver/guide
- For groups of 20+ students, a professional driver and guide
- Roundtrip transportation in people carriers, minibuses, buses as appropriate
- All entrances, accommodation and meals as stated in the itinerary
- For groups of 10+ 1 free place for an adult accompanier
13. A deposit of 10% of the total tour price is payable on booking.
14. Cancellation fees will apply as follows:
For 1 day tours:
- 10 days or more prior to departure - no fee
- 1-10 days prior to departure - loss of the deposit i.e. 10%
- Cancellation made on the day prior to or of departure, or after travel has commenced - 100% of the fee.
For 2+ day tours:
- 35 days or more prior to departure - no fee
- 14-34 days or more, loss of the deposit
- 2-13 days or more, 50% of the tour fee
- Cancellation made on the day prior to or of departure, or after travel has commenced - 100% of the fee
15. E-Tours does not permit smoking on board any of its vehicles.
16. Total luggage must not exceed an overnight bag that can be stored underneath the passenger's seat and whose maximum dimensions are 50cm long x 40cm wide x 20cm deep unless other arrangements are made prior.
English Courses
17. Enrolment is only made when E-Tours Ltd. receives the completed Enrolment Form by mail or by fax and payment of all fees due.
19. Each student or, in the case of a student under the age of 21 years, the student's parent or guardian, must individually sign a student declaration on the Enrolment Form (see below) to confirm his/her understanding of the conditions of enrolment.
19. E-Tours Ltd. reserves the right to decline an enrolment entirely at its discretion and without giving reasons.
20. E-Tours Ltd. observes all New Zealand public holidays and closes for the two weeks in which Christmas and New Year are celebrated, unless otherwise expressly stated in the itinerary.
21. Payment is in New Zealand dollars and can be made by internet banking or by money order, credit card (Mastercard or Visa) or by direct deposit into the E-Tours Ltd. bank account (details of which are provided on the invoice).
22. E-Tours is not responsible for any fluctuations in currency exchange rates which may result in a passenger being charged more than the published or quoted price, nor is it responsible for any bank or other third party charges made in relation to foreign currency transactions.
23. All tuition, activities and excursion fees include the New Zealand Government Goods and Services Tax (GST) - 12.5%.
24. E-Tours Ltd. reserves the right to modify its course arrangements and to alter its specifications and fees without prior notice at any time before payment is made.
25. If any services or facilities included in the fees are not used, except for unused accommodation, no refund or deduction can be granted.
26. If notification of cancellation is received in writing not less than 42 days before the commencement of the course, E-Tours Ltd. will refund all accommodation, tuition, activities and excursion fees, less the registraton and the accommodation placement fees.
27. If notification of cancellation is received in writing more than 14 days and less than 42 days before the commencement of the course, E-Tours Ltd. will refund all accommodation fees but will retain the registraton fee, the accommodation fee and 50% of the tuition, activities and excursion fees.
28. No refund of tuition, activities or excursion fees will be given for cancellation within 7 days of the commencement of the course for any reason. E-Tours Ltd, may, at its discretion, refund a portion of these fees on compassionate grounds.
29. Refunds will be paidIn New Zealand dollars (NZ$) and by cheque sent to the registered address of the person or institution that made the original payment.
30. Each student agrees to abide by the E-Tours Rules and by New Zealand law. The student will be asked to sign a copy of the E-Tours Rules to show that they have understood and agree to be bound by their terms. These Rules are published in English and the English version will be binding in all cases. Where possible, copies will be made available in the student's first language but this cannot be guaranteed. All reasonable steps will be taken, however, to ensure that the student understands the meaning of such rules and regulations on signing.
31. Please note that a student may ultimately be required to leave the programme at their expense and without refund of any unused portion if they fail to observe the above rules at the discretion of E-Tours.
32. Homestay accommodation may be changed only at the discretion of E-Tours Ltd. In the event that a student requests a change, a decision will be made by E-Tours Ltd. in consultation with the student and the student's escort teacher/representative.
33. A student may not leave a host family's home and stay elsewhere during the programme without prior written approval from the student's parents as well as a detailed schedule and the consent of E-Tours Ltd.
34. E-Tours Ltd. acts only as an agent in arranging homestays and cannot be held responsible for any accident, illness, or damage to a student or a student's personal possessions during a student's stay with the host family. The student is responsible for providing insurance to cover these risks.
35. E-Tours requires all students to have insurance that includes cover for health, accident, theft, loss or damage to personal possessions and loss of non-refundable deposits (including course fees). This can be arranged by E-Tours on request.
36. E-Tours is not liable for any loss, damage or injury to persons, or property, howsoever or by whomsoever caused, save where liability is expressly imposed beyond exclusion b New Zealand law.
37. In the event that weather conditions render a particular activity impossible with sufficient notice for an alternative to be arranged, E-Tours will offer a suitable alternative activity or the same activity on a mutually agreeable alternative date.
38. Once a course/trip/activity is running E-tours reserves the right to vary the itinerary & schedules and to arrange alternative transportation & services where road, weather and other operational needs render such course of action necessary in the interests of the students. In such circumstances, we will do our best to supply comparable services, accommodation and itineraries and there shall be no refund in this respect.
